Does an employee who resigns in Kuwait get the end-of-service award?

The short answer

Yes, depending on length of service. Under Article 53 of Kuwait's Private Sector Labor Law, an employee who resigns from an open-ended contract gets nothing with less than three years of service, half the award from three to five years, two thirds from five to ten years, and the full award after ten years.

Step by step

  1. 1

    Identify the contract type

These rates apply to resignation from an open-ended contract.

  2. 2

    Calculate the full award first

15 days for each of the first five years and a month for each year after that, capped at 18 months of wages.

  3. 3

    Apply the resignation rate

Under 3 years: nothing. 3 to under 5: half. 5 to under 10: two thirds. 10 years or more: the full award.

  4. 4

    Fixed-term contracts

When a fixed-term contract ends without renewal, the full award is due.

A common mistake

The date the resignation was submitted and the last working day set the exact length of service, so document both in writing.
