Under Article 156 of Labor Law No. 14 of 2025, either party ending an open-ended contract must give the other written notice three months ahead. The parties may not agree to waive or shorten the notice, but may agree to lengthen it, under Article 161.
Step by step
- 1
Runs from receipt
The notice period starts on the date the notice is received, and notice cannot be made conditional, under Article 158.
- 2
Not during leave
Notice may not be given to a worker during his leave, and if he takes sick leave during the notice period, it stops until the leave ends, under Article 159.
- 3
The contract continues
Both parties keep all their obligations until the period ends, and the employer may release the worker from work while counting the period as service and paying for it, under Articles 160 and 163.
- 4
Time to look for work
If the employer gave notice, the worker may take one full day or 8 hours a week off with pay to look for work, telling the employer the day before, under Article 162.
- 5
Ending without notice
If the employer ends the contract without notice or before the period ends, he must pay the wage for the notice period or the part left, which counts as service, under Article 164.
- 6
Releasing a resigning worker
The employer may excuse the worker from all or part of the notice period when the worker is the one ending the contract, under Article 161.
Many contracts still say two months under Article 111 of the old law. Update contracts and forms to three months, because Article 161 does not allow agreeing to a shorter period.
