How many days of annual leave does Oman's new labor law give?

The short answer

Under Article 78 of the Labor Law issued by Royal Decree No. 53 of 2023, a worker is entitled to annual leave of at least 30 days on the total wage. It cannot be taken before at least six months have passed from the date the worker joined.

Step by step

  1. 1

    Length and pay

At least 30 days a year, on the total wage and not on the basic wage alone.

  2. 2

    First leave

After at least six months from the joining date.

  3. 3

    Timing and postponement

Leave is granted according to work needs. The employer may postpone it, when work needs require, by six months at most, and the worker must take leave of at least 30 days at least once every two years, under Article 81.

  4. 4

    Splitting and balance

Leave may be split according to work needs except for juvenile workers, and the worker may keep a balance of no more than 30 days unless the leave went unused because of work needs.

  5. 5

    Cash payment

During employment the basic wage may be paid for unused days with the worker's written consent, and at the end of service the worker gets the total wage for the balance.

A common mistake

Paying the leave balance at the end of service on the basic wage is a common mistake, because Article 81 gives the worker the total wage for the balance.
