How long is the probation period under UAE labor law?

The short answer

Under Article 9 of Federal Decree-Law No. 33 of 2021, probation lasts six months at most from the start of work and only once per employer. The employer may end the contract during it with at least 14 days' written notice.

Step by step

  1. 1

Set the length in the contract

Six months at most, and an employee cannot be put on probation more than once with the same employer.

  2. 2

    Ending by the employer

Written notice to the employee at least 14 days before the end date.

  3. 3

    Moving to another UAE employer

The employee gives the employer written notice of at least one month, and the new employer compensates the original employer for recruitment or contracting costs unless agreed otherwise.

  4. 4

    Leaving the country

A foreign employee gives at least 14 days' written notice, and if they return and get a new work permit within three months, the new employer owes the same compensation.

  5. 5

    Breaching the notice

The party that breaches the article pays the other the wage for the notice period or what remains of it.

A common mistake

Ending a probationer's contract on the spot without 14 days' notice is a common mistake, and it makes the employer liable for the notice period wage.
