What is the notice period for ending an employment contract in the UAE?

The short answer

Under Article 43 of Federal Decree-Law No. 33 of 2021, notice is at least 30 days and at most 90 days. It must be the same for both parties unless it favors the employee, and the employee receives full pay during notice, based on the last wage.

Step by step

  1. 1

Set the period in the contract

Between 30 and 90 days, and the same period for employer and employee unless it favors the employee.

  2. 2

    Give written notice

Either party may end the contract for a legitimate reason with written notice, and the contract continues during the notice period.

  3. 3

    Payment in lieu

The party that does not observe the notice pays the other an allowance equal to the employee's wage for the whole period or the remaining part, even if no harm resulted.

  4. 4

    Use the last wage

The allowance is calculated on the last wage the employee received, and on the average daily wage for piece-rate workers.

  5. 5

A day to look for work

If the employer ends the contract, the employee may take one unpaid day a week during notice to look for work, giving at least 3 days' notice.

A common mistake

Writing a longer notice period for the employee than for the employer is a common mistake, because Article 43 requires one period for both parties unless it favors the employee.
