Under Article 117 of Labor Law No. 14 of 2025, actual work may not exceed 8 hours a day or 48 hours a week, excluding meal and rest breaks. Overtime pay is at least the normal hourly wage plus 35% for daytime hours and 70% for night hours, under Article 121. Articles 117 to 119 do not apply to the employer's authorized agents, workers on preparatory and complementary tasks, or guards and cleaners, under Article 123.
Step by step
- 1
Rest breaks
One or more meal and rest breaks totaling at least an hour, so that no one works more than 5 hours in a row, under Article 118.
- 2
Maximum time at work
The span from start to end of the working day may not exceed 10 hours under Article 119, and time at work including overtime may not exceed 12 hours under Article 121.
- 3
Weekly rest
Paid rest of at least 24 full hours after no more than 6 consecutive working days, under Article 120.
- 4
When overtime is allowed
Only to meet unusual work needs or exceptional circumstances, with notice of the reasons and duration to the competent administrative authority within 7 days. Article 85 of the old law required its written approval.
- 5
Work on the rest day
The worker is entitled to an amount equal to his wage as compensation for that day, and the employer gives him another day off in the following week.
- 6
Post the schedule
Article 122 requires the rest day, working hours and breaks to be posted in a visible place, with a copy or any change sent to the administrative authority within 7 days.
Paying overtime at the normal hourly rate is a common mistake. The minimum is the hourly wage plus 35% by day or 70% at night, and night is the period between sunset and sunrise under Article 1.
