Under Article 124 of Labor Law No. 14 of 2025, annual leave is 15 days in the first year, then 21 days from the second year. It rises to 30 days after ten full years with one or more employers or above the age of fifty, and to 45 days for persons with disabilities and persons of short stature, excluding public holidays and weekly rest days.
Step by step
- 1
Less than a year of service
The worker gets leave in proportion to the time worked, provided he has completed at least six months with the employer.
- 2
Hazardous work and remote areas
Leave increases by 7 days for work that is hazardous or harmful to health, or in remote areas, as set by a decision of the competent minister.
- 3
The employer sets the dates
Under Article 125 the employer schedules leave to suit the work. The worker cannot give up leave, and if he refuses in writing to take it, he loses the right to payment for it.
- 4
A minimum that must be taken
The worker must take 15 days a year, including at least 6 consecutive days, and the employer must settle the balance or pay for it at least every three years.
- 5
Balance at the end of service
If employment ends before the worker has used his balance, he is paid for it.
- 6
Casual leave
Under Article 128 a worker may be absent for an emergency for 7 days a year, up to two days at a time, deducted from annual leave.
Letting balances build up for years without settlement is a common breach. The law requires the balance to be settled or paid at least every three years, so review balances every year.
