The competent medical body sets the length of sick leave, and wage compensation is 75% for the first 90 days and 85% after that. Article 131 of Labor Law No. 14 of 2025 refers the rate and duration to Social Insurance and Pensions Law No. 148 of 2019, whose Article 76 says compensation cannot fall below the minimum wage and lasts no more than 180 days in a calendar year.
Step by step
- 1
Proof of illness
Sick leave is set by the competent medical body, not by the employee or the manager, so ask for a certified medical certificate for every absence.
- 2
Compensation rate
75% of the daily wage on which contributions are paid for the first 90 days, then 85% of it, up to 180 days in a calendar year.
- 3
Chronic illness
A worker with a chronic illness receives compensation equal to the full contribution wage for the whole illness, until recovery, a stable condition or proven total disability.
- 4
Contribution condition
Article 73 of the Social Insurance Law requires three consecutive months of contributions, or six non-consecutive months of which the last two are consecutive.
- 5
Industrial establishments
In an industrial establishment covered by Law No. 15 of 2017, a sick worker gets, for every three years of service, three months of sick leave with pay, then six months at 85% of pay, then three months at 75%, if the medical body expects recovery, less what insurance pays.
- 6
Annual balance and job protection
The worker may add his accrued annual leave to sick leave, and his contract cannot be ended for illness until both are used up, under Articles 131 and 173.
Deducting sick days from salary in full is a mistake, because wage compensation is the worker's right. Find out who pays it in your company: the competent body, or the company itself if the head of the insurance authority exempted it from the wage compensation share of the sickness contribution in return for paying it, under Article 70 of the Social Insurance Law.
