Under Article 109 of the Labor Law, annual leave is at least 21 days and rises to at least 30 days after five continuous years with the same employer. It is paid in advance, and it cannot be waived or exchanged for cash during employment.
Step by step
- 1
Set the entitlement
At least 21 days for each year, and at least 30 days once five continuous years of service with the employer are complete.
- 2
Schedule early
The employer sets leave dates according to work needs and notifies the employee of the date at least 30 days in advance.
- 3
Pay it in advance
Annual leave pay is paid before the leave starts, and the employee takes the leave in the year it is due.
- 4
Postpone within limits
The employee may postpone it to the next year with the employer's approval. The employer may postpone it by up to 90 days after the end of the year it is due when work conditions require, and longer needs the employee's written consent and cannot go beyond the end of the following year, under Article 110.
- 5
Balance at the end of service
An employee who leaves is paid for the leave days due and not taken, under Article 111.
Paying cash instead of granting leave during employment breaches Article 109. Cash is paid only for the remaining balance when the employee leaves.
