Under Article 75 of the Labor Law, on an open-ended monthly-paid contract, notice is at least 30 days from the employee and 60 days from the employer. If the wage is not monthly, notice is at least 30 days for either party, in writing and for a legitimate reason, under the amendments in force since 19 February 2025.
Step by step
- 1
Identify the contract type
The notice periods in Article 75 apply to open-ended contracts. A fixed-term contract ends when its term ends unless it is renewed.
- 2
Give written notice
The notice is sent in writing at least the required period before the end date, and the termination must rest on a legitimate reason.
- 3
If notice is not served
The party that does not observe the notice pays the other an amount equal to the employee's wage for the notice period, unless the parties agree on a higher amount, under Article 76.
- 4
Resignation acceptance period
A resignation is deemed accepted after 30 days without a reply, and the employer may defer acceptance for up to 60 days with a reasoned written explanation, under Article 79 bis.
- 5
Ending without a legitimate reason
The harmed party gets the compensation set in the contract, or otherwise 15 days' wage for each year of service under an open-ended contract, with a minimum of two months' wage, under Article 77.
Keeping the notice clause of contracts written before the February 2025 amendments took effect, without reviewing it, is a common mistake. Amended Article 75 sets a minimum of 30 days' notice from the employee and 60 days from the employer when the wage is monthly.
